JOLT® JEAN STORY SWEEPSTAKES RULES

1. NO PURCHASE NECESSARY TO PLAY OR WIN. THE PURCHASE OF ANY GOOD AND/OR SERVICE WILL NOT INCREASE A PARTICIPANT’S CHANCE OF WINNING This Sweepstakes is sponsored by Kellwood Company, 1407 Broadway, Suite 611, New York, NY 10018 (“Sponsor”). The Sweepstakes entry period starts on October 22, 2009 at 12:00 a.m. Eastern Time ("ET") and ends on December 13, 2009 at 11:59 p.m. ET. Mailed entries and e-mail entries must be received by 11:59 PM ET on December 13, 2009. Eligibility for entry into the Sweepstakes will cease at the applicable time and date and all entries received thereafter will be considered disqualified and will be ineligible for participation. If Sponsor does not receive your entry for any reason, or if your entry is not entered correctly, the entry will be invalid and you will be ineligible to participate or win.

2. ELIGIBILITY: ONLY LEGAL RESIDENTS, WHO ARE THIRTEEN (13) YEARS OF AGE OR OLDER, RESIDING IN THE FIFTY (50) U.S. STATES AND THE DISTRICT OF COLUMBIA, ARE ELIGIBLE TO PARTICIPATE OR WIN. SPONSOR DOES NOT WARRANT THAT THIS SWEEPSTAKES IS VALID IN ANY PARTICULAR JURISDICTION. RESIDENTS OF JURISDICTIONS WHERE THIS SWEEPSTAKES IS PROHIBITED ARE INELIGIBLE TO COMPETE IN THIS SWEEPSTAKES. THIS SWEEPSTAKES IS VOID WHERE PROHIBITED. If you are under eighteen (18) years of age, you must have your parent’s or guardian’s written permission before providing personal information to participate. Your personal information will be used in accordance with Kellwood Company’s Privacy Policy. By submitting an entry, you consent to the collection, processing, use and disclosure of the information contained in your entry according to Kellwood Company’s Privacy Policy. Employees of Sponsor, or any of its subsidiaries and parent companies, or any company retained by Sponsor to promote, administer or provide advice with respect to the Sweepstakes, and members of any of their immediate families, are not eligible to participate.

3. HOW TO ENTER: Each participant may enter the Sweepstakes only one time. Each entry must include (i) the name, mailing address, e-mail address (if entering via www.everypairtellsastory.com), daytime telephone number, and age of the participant, as well as (ii) an essay of one hundred fifty words (150) or less which explains your jean story in your own words. Be creative. If multiple entries are submitted by any participant, only the first entry received by Sponsor (as determined by the Sponsor) will be entered into the Sweepstakes. An e-mail entry will be deemed to have been submitted by the holder of the e-mail account from which it was sent. For these purposes, an e-mail account holder shall mean the natural person assigned to such e-mail account by the Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with such e-mail account.

There are two ways to enter. Eligible participants may enter either by (1) visiting www.everypairtellsastory.com and submitting an entry by following the instructions on the website, or (2) entering by mail by printing your name, mailing address, daytime telephone number, age, and your jean story and mailing to: Jolt Jean Story Sweepstakes Entry, Kellwood Company, 1407 Broadway, Suite 611, New York, NY 10018, Attn: Marketing. A mail-in entry will be treated in the same manner as an entry received through www.everypairtellsastory.com. Sponsor reserves the right in its sole discretion to reject any entry for failure to fully comply with the entry rules.

4. PRIZE: [One (1) Grand Prize, One (1) Second Place Prize, Five (5) Third Place Prizes, and Ten (10) Fourth Place Prizes]: All eligible participants will be competing for one (1) Grand Prize, one (1) Second Place Prize, five (5) Third Place Prizes, and ten (10) Fourth Place Prizes. The Grand Prize shall consist of an iPod Touch with an approximate retail value of one hundred ninety-nine dollars (U.S. $199.00). The Second Place Prize shall consist of an iPod Nano with an approximate retail value of one hundred seventy-nine dollars (U.S. $179.00). The five Third Place Prizes shall each consist of an online store credit with a retail value of one hundred dollars (U.S. $100.00) to be utilized exclusively on www.joltstyle.com. The ten Fourth Place Prizes shall each consist of an online store credit with a retail value of fifty dollars (U.S. $50.00) to be utilized exclusively on www.joltstyle.com. Each Winner will be selected by random drawing on or about December 31, 2010, from all eligible entries received for the drawing and will be notified via certified, return receipt mail and/or by email. Within fourteen (14) days of receipt of prize notification, each Winner will be required to sign and return to Sponsor a consent and release agreement. In the event of non-compliance with any of the rules set forth herein, including any Prize notification returned as undeliverable, such Winner’s Prize may be forfeited and awarded to an alternate Winner. Sponsor is not responsible for, and shall not be liable for late, lost, misdirected or unsuccessful efforts to notify each respective Winner.
The reporting and payment of all tax liabilities, if applicable, incurred by any Winner as a result of the Sweepstakes is the sole responsibility of each Winner. All federal, state, and local laws and regulations apply. Each Prize is awarded AS IS and WITHOUT WARRANTY OF ANY KIND, expressed or implied, including, without limitation, any implied warranty of merchantability or fitness for a particular purpose. No substitution of any Prize will be permitted, except by Sponsor, which may substitute Prizes of equal or greater value if the advertised Prizes become unavailable. Each Prize is non-transferable and may not be redeemed for cash. Odds of winning will be dependent upon the number of entries received.

5. SWEEPSTAKES WINNERS: The name of each Winner will be posted at www.joltstyle.com, and the identity of each Winner may also be obtained by writing to Jolt Jean Story Sweepstakes, Kellwood Company, 1407 Broadway, Suite 611, New York, NY 10018, Attn: Marketing.

6. GENERAL: These rules may be obtained at www.everypairtellsastory.com or by sending a self-addressed stamped envelope to: Jolt Jean Story Sweepstakes, Kellwood Company, 1407 Broadway, Suite 611, New York, NY 10018, Attn: Marketing, within thirty (30) days of the Sweepstakes’ deadline date. Residents of Vermont may omit return postage. Questions regarding this Sweepstakes may be sent to the address above. By entering the Sweepstakes, you agree to these rules and all eligibility requirements and all decisions of Sponsor. By accepting a Prize, each Winner agrees that the Sponsor and those acting under the Sponsor’s authority may use the respective Winner’s name, biographical information, pictures/portraits, likenesses and/or voice for advertising and promotional purposes without further consideration at the sole discretion of Sponsor, unless prohibited by law. BY ACCEPTING A PRIZE, EACH WINNER AGREES THAT THE SPONSOR, AND ALL OF ITS RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, WILL HAVE NO LIABILITY WHATSOEVER FOR, AND WILL BE HELD HARMLESS BY WINNER FOR, ANY LIABILITY, INJURY, LOSS OR DAMAGE OF ANY KIND, INCLUDING DEATH, TO PERSONS AND PROPERTY, DUE IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZE OR PARTICIPATION IN THIS SWEEPSTAKES. All entries become the sole property of Sponsor and none will be returned. If for any reason the Sweepstakes is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, human error or any other causes beyond the control of Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes and award the Prize from among all eligible entries received prior to cancellation or termination. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems or traffic congestion on the Internet or at any website, any combination thereof, or otherwise, including any injury or damage to any participant’s, or any other person's, computer related to or resulting from participation or downloading any materials in the Sweepstakes. CAUTION: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY DAMAGE www.joltstyle.com or www.everypairtellsastory.com OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right to verify the eligibility qualifications of each Winner. This Sweepstakes is governed by Missouri law.

7. RIGHT OF NON-PARTICIPATION: Pursuant to federal law, any participant has the right to notify the Sponsor that he/she does not wish to be contacted by the Sponsor regarding any future Sweepstakes or Contests or mailings and that Sponsor may not use any information provided to it by such participant for any purposes other than as needed for this Sweepstakes.
